Walking Out The Door With Trade Secrets

It’s one of the more difficult legal balancing acts in commercial jurisprudence: the right of employers to prevent misappropriation of trade secrets versus the right of employees to use their knowledge and experience to get the job they want. Chris Neumeyer, managing partner of Asia Law, provides a detailed look at the law addressing these issues in the United States as compared to several Asian countries, including China, Japan and South Korea, as well as Hong Kong.  The law varies, but for companies that want to minimize the chance of litigation there are at least three basic practices that should be universal in any jurisdiction.
