Rite Aid Worker Fired By New Supervisor Can Continue Discrimination Suit, Court Finds

A federal district court in Maryland found that a Rite Aid employee who suffers from lupus may go forward in a lawsuit against a supervisor whom she claims discriminated against her because of her gender and FMLA status. Though the employee had performance issues, her previous supervisor wrote in a recommendation that she showed “immense improvement.” But weeks later, the new supervisor – who had refused to talk to her directly – made the decision to have her fired. The court rejected here ADA wrongful discharge claim, but allowed her FMLA and Title VII retaliation claims to proceed.
