When social media comment turns negative and begins to harm a business, is there anything the organization can do about? Attorney Michael M. Ratoza of the West Coast firm Bullivant Houser Bailey PC considers the options. Those options are circumscribed by law, including, in California, a new “Yelp Bill” that prevents a business from including a non-disparagement clause in terms-of-service or other consumer contracts, and in other states by various media shield and anti-Slapp laws. Still, legal avenues may still exist, but there is a non-legal strategy that often has a better outcome.
