Random Alcohol Tests Upheld In ADA Appeal

Random drug tests administered by U.S. steel at a coke manufacturing plant were challenged by the EEOC as an ADA violation. The U.S. District Court for the Western District of Pennsylvania rebuffed the challenge, accepting U.S. Steel’s contention that the policy was job-related and consistent with business necessity. Count it as a win for employers, although probably not one that merits much of a victory toast. Clearly this job site was no place to be tipsy.
