Must Employees Be Paid During Snowmageddon Shutdown?

With a massive snow storm set to hit New York and New England, the Duane Morris Institute issues a reminder of the FLSA requirements for paying employees during a weather-related shutdown. If the shutdown lasts less than a week, exempt employees must be paid for full or partial closed days. Those leaving early or staying late must be paid for the full day, though an employer may require exempt workers use paid time off.
