The employer – the U.S. Department of Commerce – claimed it had decided to terminate the employee before she went on medical leave, but that she left before the action could be carried out. A federal district court in Virginia didn’t find that argument persuasive enough to merit dismissal, and it explained its determination “in words every employer should heed,” say attorneys from Jackson Lewis.
