Is Stealing Company Documents Protected Activity?

After discovering that an employee has stolen or downloaded confidential information, a course of action that seems obvious – investigation followed by discipline, possibly including legal action – needs to be considered in light of the employee’s potential claims against the company and any whistleblower protections that may come into play. In this context, courts have generally looked at six factors to determine whether taking company documents was reasonable.
