HR Managers Hit Lowe’s With Overtime Class Action Suit

Even HR departments are not immune from overtime lawsuits, as Lowe’s found out when they were hit with a class-action claim from HR managers claiming they were not given enough authority to merit their overtime-exempt status. To protect from similar overtime suits, Cozen O’Connor attorney David Barron suggests maintaining records of exempt HR employees’ involvement in hiring, firing, or discipline of employees, keeping in mind that exempt employees need only have their recommendations on hiring and firing given substantial weight to qualify.
