EEOC Clarifies Rules On Criminal History Checks

Speaking at a recent workshop at the Washington DC office, a senior EEOC attorney clarified three common misconceptions. The first misconception is that employers are prohibited from using criminal background information in making employment decisions. “Disparate impact” is the key concept, and employers need to understand how it gets applied.
