DOMA Decision Will Impact Employee And Immigration Benefits

The Supreme Court last month struck down a section of the federal Defense of Marriage Act that said someone could be considered a spouse for purposes of federal law only if the relationship was between persons of the opposite sex. This decision will have a major impact on both employee benefits and immigration benefits. Regulators are working on guidance, but some changes are clear at the outset and employers will need to make good faith efforts to comply.
