Company Doesn’t Have To Open Books If It’s “Unwilling” To Pay Union

After a company that has one plant in the U.S. and one in Mexico said it was “unwilling” to meet union pay demands, the union demanded to see the financials. The NLRB affirmed that in such cases, as opposed to those where the company claims it is “unable” to pay, there is no requirement to open the books. The NLRB also made clear, however, that there were cases where an unwilling company would have to open the books, and explained why this wasn’t one of them.
