Can A Facebook Status Update Violate A Non-Compete?

If departing employees update their social media followers – including clients – about a new job, does that violate non-compete contracts? Two recent Massachusetts cases suggest that using Facebook or LinkedIn merely to post notice of a job change would not violate a standard non-compete or non-solicitation contract. Without evidence that a former employee has used social media to contact clients for the express purpose of gaining their business with a new employer, Massachusetts courts have deemed the cases insufficient to warrant injunctive relief.
