Health insurance ranks among the top costs for employers, and wellness programs, typically popular with employees as well as employers, can bring lower premiums. But for companies setting them up there are numerous legal pitfalls. A Today’s General Counsel article by attorneys from law firm Carothers DiSante & Freudenberger LLP looks at recent developments in this area, and in particular the final rules for employer wellness programs with respect to the Americans with Disabilities Act (ADA) and “GINA,” the Genetic Information Nondiscrimination Act. The rules were issued earlier this year by the Equal Employment Opportunity Commission.
