Trade Groups Must Mind Antitrust Rules

Two recent settlements with the Federal Trade Commission are a reminder that all trade associations walk a thin between promoting legitimate common interests and engaging in activity that runs afoul of antitrust laws. In one case, the FTC alleged that four provisions of a conduct code that a trade group maintained would promote “ethics” in fact illegally restrained its members from competing with each other.
