They are a good indicator of how federal judges are looking at e-discovery issues now even though they won’t come into effect for more than two years. No surprise in the overall goals: earlier case management by judges, “proportionality,” and better cooperation among litigants. There are also some specifics. Among them: Boilerplate objections will be curtailed, and cost-shifting authority will be clarified.
