A Cyber-breach is a thing unto itself, or so the carrier is likely to argue when the victim seeks coverage under a commercial general liability policy. The facts and the precise wording of the policy are crucial, as always, but when a super market chain suffered a data breach, compromising as many as 2.4 million of its customer credit and debit cards, the carrier balked and argued there had been no “occurrence,” no bodily injury and no property damage.
