Weinstein’s Insurers Don’t Want To Pay

Accused movie producer Harvey Weinstein argues that Federal Insurance Co, a Chubb subsidiary, is obligated to defend and indemnify him in 14 lawsuits that accuse him of sexually harassing and assaulting women. Chubb is denying coverage on a number of grounds, including that the claimed damages arose out of Weinstein’s “ongoing and pervasive, and allegedly criminal, acts of premeditated, forcible, non-consensual sexual and physical assault, physical threats and abuse,” and that such “egregious, intentional acts by Weinstein do not constitute an ‘occurrence’ …” Among the argument being marshaled by Weinstein’s attorneys: There are applicable policies, including general liability policies with crisis management benefits, that do not include the exclusions being cited by the insurers.
