Value Of Dogs “Beyond Legal Measure”

Georgia’s high court this week ruled that the sentimental bond between a dog and its owners cannot be measured in recoverable dollars. That relationship, “while cherished, is beyond legal measure,” Georgia Chief Justice Hugh Thompson wrote. Lawyers Elizabeth and Bob Monyak have asked the Georgia Supreme Court to consider their case alleging that their dachshund, Lola, died as a result of negligence by Barking Hound Village kennel. After a stay at the kennel, during which time the Monyaks allege Lola was given medication she was not meant to receive, the dog suffered kidney failure and ultimately died. They fought for the right to submit evidence of the dog’s value, including “non-economic factors demonstrating the dog’s intrinsic value,” but the court maintained that the Monyaks could only seek to recover “reasonable veterinary and other expenses they reasonably incurred in trying to save her.” Barking Hound Village denies the allegations.
