Among the most critical laws is the Health Insurance Portability and Accountability Act (HIPAA), which sets federal standards for safeguarding patient health information. Its Privacy and Security Rules define protections for both physical and electronic data, with penalties reaching $250,000 and prison time for severe violations. The Health Information Technology for Economic and Clinical Health (HITECH) Act builds on HIPAA by promoting electronic health record adoption, strengthening breach notification requirements, and raising civil penalties.

The Anti-Kickback Statute prohibits payments intended to induce patient referrals, with potential liability of up to $50,000 per kickback and exclusion from federal programs. Similarly, the Stark Law bars physicians from referring Medicare patients to entities with which they have financial ties, carrying strict liability penalties of up to $15,000 per improper claim. Finally, the False Claims Act (FCA) targets fraudulent billing to Medicare and Medicaid, producing more than $1.67 billion in healthcare settlements in fiscal year 2024, according to the Department of Justice.
