Two nearly identical trade secret cases in the Second Circuit, both involving theft of source code used to execute high speed trades in the financial industry, had diametrically different outcomes. In one, the accused kept it in the form of “ESI” and contrived to make it end up on his home computer. The other printed it out. One got prison, the other went home.
