Supreme Court Passes On Weed Lawsuit

The Supreme Court will not hear a case pitting Nebraska and Oklahoma against Colorado over the legalization of marijuana in that state. Nebraska and Oklahoma bypassed having their suit heard in lower courts by invoking the rarely used “original jurisdiction,” and argued that the 2012 ballot initiative in Colorado that allowed for the recreational use of pot has led to marijuana being smuggled across their borders. They also noted that federal law still prohibits weed, and said Colorado’s law creates a “dangerous gap” in the federal government’s handle on illegal drugs. Clarence Thomas and Samuel Alito said they would have heard the case.
