SCOTUS To Rule On Electricity Regulation

The Supreme Court has agreed to decide whether federal regulators may encourage electricity users to reduce consumption at peak times in exchange for mandated price breaks. Trade groups representing utilities and power suppliers that saw their revenues drop challenged that type of regulation, saying that the Federal Energy Regulatory Commission had overstepped its authority. Last May, a divided three-judge panel of the United States District Court for the District of Columbia agreed with the trade groups.
