SCOTUS Obamacare Case: The Next Bush v. Gore?

When the Supreme Court decided to take up another Affordable Care Act lawsuit last week, it set the stage for a ruling that could effectively dismantle the legislation, a cornerstone of the Obama presidency. The case centers on the wording of a statute which, if interpreted “robotically,” could end the tax credits that make the Affordable Care Act affordable for low- to middle-income consumers. Chief Justice John Roberts is likely to once again cast the deciding vote in the decision – as he did in the last Obamacare case, when he effectively saved the program. Fortune magazine senior editor Roger Parloff asks: “Will he save the law a second time, recognizing the damage that the Supreme Court will incur to its credibility as an institution if the Court, voting on strict party lines, destroys Obamacare over what certainly looks like a simple drafting error?”
