Scheindlin Orders Bank To Turn Over Confidential Documents

The name Shira Scheindlin, judge in U.S. District Court for the Southern District of New York, is familiar to many corporate practitioners as the author of the seminal Zubalake decision on e-discovery. Judge Scheindlin made headlines last week when the Court of Appeals for the Second Circuit chastised her for publicly discussing New York City’s stop-and-frisk policy and took her off the case. She’s also made waves recently in a less widely noticed case, in an area of more direct interest to corporate practitioners, by setting some limits on a document privilege claimed by banks.
