Sarah Palin Sued For Using, Misattributing, 9/11 Image

The copyright owner of “Raising the Flag at Ground Zero,” an image of firemen hoisting an American flag amidst World Trade Center ruins, has sued Sarah Palin for using the photograph on the website for her political action committee and on her Facebook page, and incorrectly designating the origin of the photo. The suit claims that the picture is being used in such a way that one may easily confuse Palin or her PAC as copyright owners of the image. Palin’s group moved to dismiss on the basis of, among other things, fair use, saying “commercial use” is no different from Google’s Books Project, recently ruled legal.
