Record Year For ADA Title III Lawsuits

At just over 11,000, the number of ADA Title III lawsuits in 2019 was another all-time record. Law firm Seyfarth Shaw says this was the highest number since it started tracking the category in 2013, and it was just 2,722. Included are lawsuits related to physical facilities, websites and mobile applications, service animals, and sign language interpreters, among others. Eighty-four percent of the total came out of just three states: California, New York, and Florida. In a separate post earlier this year the firm identified major trends that drove these numbers. They include lawsuits that cite a failure to offer fully informational braille gift cards, and a large number of suits alleging websites fail to incorporate software that will read aloud, or fail to have closed captioning options on their videos.
