Race In College Admissions Before SCOTUS, Again

The constitutionality of the admissions policy at the University of Texas is getting another review before the Supreme Court. Justice Kagan will recuse herself because she was serving in the Obama administration when the policy was being assessed by the DOJ. The grant of review of Fisher v. University of Texas at Austin – the Court’s second look at that case – signaled possible discontent with the way a federal appeals court had carried out a review. The discontent seems to stem from the fact that Texas can continue to use race as one factor in admissions.
