Doing business in Cuba and Iran is no longer a far-fetched notion, and with that in mind Holland & Knight attorneys Thomas W. Brooke and Jessica E. “Jesse” Lanier look at trademark law in those two recently opened venues. In Iran, prospective applicants need to be aware of a number of significant restrictions on what can be trademarked, as well as Iran’s own boycott rules. In Cuba, some peculiarities in the trademark law make it especially important to register a U.S. brand as quickly as possible. Even for countries that will not be doing business in either country, the authors write, it may be important to understand their IP law for defensive purposes.
