Proposed Fed Rules Changes Would Lighten E-Discovery Load

Borrowing heavily from the “Duke Rules” – recommendations from a 2010 conference at Duke University – changes in the Federal Rules proposed by the Judicial Conference Committee would “address the overbroad preservation many litigants and potential litigants felt they had to undertake to ensure they would not later face sanctions.” What some regard as fishing would probably become a lot more difficult. Limitations on depositions and interrogatories are on the table, as well. The comment period closes on Feb 15, 2014, and three hearings are scheduled in the meantime.
