Philip Morris Can’t Get Out Of Cigarette Whistleblower Suit

A three-judge panel from the DC Circuit overruled a district court decision, saying Philip Morris USA must defend a whistleblower lawsuit claiming it overcharged military personnel for cigarettes. In 2008, Anthony Oliver filed a complaint that Philip Morris was not giving the Navy, Army and Air Force cigarettes at prices equal to or lower than those it was giving to other customers. The lower court had ruled the case could be thrown out after Phillip Morris said the lawsuit relied on key information that was already publicly known.
