Apple retail store workers recently garnered headlines with a class action lawsuit, claiming they were due back pay for off-the-clock time spent waiting in line and then undergoing security checks for stolen merchandise before they could go home. Similar practices are “under fire across the country,” according to this law firm alert. Employers who want to stay out of court are advised to analyze carefully the differences between practices that are acceptable, given the situation and the  rationale for the search, and those that could result in significant damage awards.
