Non-Practicing Entity Socked With Legal Fees Again

A Florida court has asked Shipping & Transit LLC to pay Lensdiscounters.com’s legal costs. This is the second time in a week that a Shipping & Transit patent litigation suit has been deemed “exceptional” for the purpose of awarding legal fees to the defendant. Lensdiscounters told the court that Shipping & Transit had failed to investigate its infringement claims before filing the lawsuit. The court agreed, and wrote that it appeared likely the plaintiff never intended to litigate, and had brought suit in hopes of a quick settlement. It also noted that in more than 300 cases Shipping & Transit filed in Florida alone, not one had reached the issue of patent validity.
