NFL Debates Racial Slur on Gridiron, Workplaces Already See it as a Red Flag

While the NFL may be having a debate about banning racist terms – in particular, the N-word – on the field of play, that kind of language is already a no-go in a typical workplace. Use of the N-word or other derogatory racial terms may be seen as contributing to a hostile work environment under the Civil Rights Act, according to FordHarrison attorney Josh Sudbury, if the complained-of conduct is severe enough that it effectively alters the employee’s working conditions. Employers should also take pains to quickly and thoroughly investigate any such claims, and take appropriate remedial measures, Sudbury says.
