More GCs Looking To “Litigation Funding”

A litigation financing ploy, formerly geared to plaintiffs and to evening out the playing field for small litigants, has gone corporate mainstream. The biggest player is a Chicago-based company called Gerchen Keller Capital, which works primarily with the country’s largest law firms, a few elite boutiques and Fortune 500 legal departments, according to an article profiling the firm in Crane’s Chicago Business. The company finances litigation for a percentage of any judgement or settlement, and is currently managing $1.4 billion in assets.
