Long Before E-Discovery, There’s Defensive Communication

Defensive communication has its own cost, but many will conclude that it’s far less than the cost of e-discovery. Don’t say what you would not want read out loud to a jury, the author advises, and assume what you write, especially in social media, will exist forever. And do not, he says, discuss liability issues in documents (unless covered by privilege).
