Law Firm Hit With TCPA Charge

A law firm has been sued under the Telephone Consumer Protection Act. The plaintiff alleges the firm violated the TCPA when it sent him, and an unknown number of others, text messages asking them to contact the firm about a $12 billion settlement that could affect their home loans. The TCPA, writes Nixon Peabody attorney Linn Foster Freedman, “continues to be a minefield for any business that is interested in marketing to mobile phones.” In particular, she notes there are some fairly new TCPA requirements pertaining to text messages. Damages can be more than $500 per violation. “This is a very hot and fruitful area right now for plaintiffs,” she writes.
