Is “Happy Birthday” Under Copyright?

Music publisher Warner Chappel says that it acquired the rights to “Happy Birthday to You” in a 1998 purchase, and it’s estimated that the company makes as much as $2 million a year licensing rights to movies and tv shows. Now the copyright claim is being challenged in two lawsuits that contend the rights have passed into the public domain.
