Gift Card Gets Lawyer In Hot Water

Disciplinary officials in Wisconsin will privately reprimand a lawyer who, after a spat with a court assistant, tossed a gift card on her desk and, when she said she couldn’t accept it, said, “What? I don’t see anything.” The lawyer, Kirk Everson, had filed for a continuance, which the court declined. When Everson failed to appear, the court filed a default judgment against his client. When the court assistant informed him of the judge’s decision, Everson responded in an “agitated and angry” tone. Afterward he attempted to give her the gift card. The disciplinary complaint accused him of, “dishonesty, fraud, deceit or misrepresentation.”
