Fifth Circuit Squelches Greenhouse Gas Tort Claim

A case that was once thought to have potential as a cutting edge precedent has been shut down – for the second time – by the Fifth Circuit Court of Appeals. The theory was that companies emitting greenhouse gases could be subject to common law tort claims. So far that theory is not working out in practice.
