Facebook’s New Photo-As-Comment Feature Will Raise IP And Ownership Questions

Facebook now permits users to upload photos as comments on the status messages of others. Those photos could be third party images. Is this “commentary” and therefore fair use? What if the photo includes an image of a product, or the users “experience” of that product? Can the brand owner rely on trademark rights and challenge an image?
