Eyewitness Misidentification Huge Factor In Overturned Convictions

Eyewitnesses forget 40 percent of what they recall in less than 20 minutes, according to trial attorney Robert Squire with Akerman Senterfitt, and that unreliability is why eyewitness misidentification is the single greatest cause of wrongful convictions nationwide, playing a role in nearly three-fourths of convictions later overturned through DNA testing. Preserving eyewitness reports as close in time to the event, either in writing or recording, is the single most important factor in having reliable testimony, Squire said.
