Everything You Own In A Box To The Left

In the standard Electronic Discovery Reference Model (EDRM) flow chart, the box farthest to the left refers to information governance – the process of getting your house in order by effectively managing information before litigation begins. In this Today’s General Counsel article, Samantha Green from legal services provider Epiq suggests another even more basic step in the process – a new box in the EDRM diagram that would reference a step preceding information governance. That step is Risk Assessment, in particular the kind of advanced data-driven risk assessment that allows companies “to dig through their data to uncover issues before they arise.” With advances in artificial intelligence, she says, this process has become sophisticated enough to “uncover stories within,” enabling companies to identify such risks as sexual harassment, data breach and fraud, and take steps to prevent them.
