Eliminate The Antitrust Exception To Corporate Charging Guidelines

In a column that appeared in Today’s General Counsel magazine, Freeborn & Peters attorney Jeffery Cross notes there is one glaring exception to a Department of Justice policy that considers the existence of a compliance program as a factor in determining whether to charge a corporation with a crime: when the crime at issue is an antitrust violation. He argues that it’s time for the antitrust division of the Justice Department to reconsider this policy.
