Death Penalty Ban “Wouldn’t Surprise” Scalia

After the Supreme Court took steps to restrict the application of the death penalty in recent years, Justice Antonin Scalia said it “wouldn’t surprise” him to see it invalidated entirely. During an appearance at the University of Minnesota Law School, Scalia said death penalty decisions from the Court have “practically made it impossible to impose it, but we have not formally held it to be unconstitutional.”
