DC Circuit: Union Not Responsible For Facebook Threats

A three-judge panel of the D.C. Circuit Court of Appeals has ruled that a union is not responsible for what its members post on private Facebook accounts, even in a case where a posting arguably constituted a threat to employees who cross a picket line. The Facebook account was accessible only to union members, and a non-union employee had argued that the union was obliged to take the offending comments down. The NLRB declined to take action, and the court says it was within its rights not to do so.
