New Ground Rules For The EU Dawn Raid

The European Commission, the body that applies EU competition law, has issued new guidance for the dawn raids it may conduct as part of its investigations. One change is that the Commission no longer accepts paper documents. Among other changes: It now requires active assistance, not just passive cooperation, during the search, and it has broadened the range of what can be seized and searched to include such devices as mobile phones, tablets, and USB keys. The dawn raid is generally considered draconian by companies, but according to Dentons attorneys, those targeted are not without rights and recourse, and in this post they provide some practical tips.
