Cyber-Malpractice & Negligence Lawsuit Hits A Chicago Law Firm

A putative class action lawsuit has been filed against a Chicago law firm over alleged cyber vulnerabilities. Two former clients of the firm allege negligence and malpractice, even as they acknowledge no clients have actually been harmed by a breach. That might be enough to make the action “fatally flawed,” as Shook Hardy & Bacon attorney Alfred J. Saikali suggests in this Lexology post, but he acknowledges that the plaintiff firm handling this lawsuit, Edelson PC, has a remarkable track record when it comes to formulating novel liability claims in privacy and data-breach cases and making them stick. In his discussion of Shore v. Johnson & Bell, Ltd., filed in federal court in Chicago, Saikali explains “the alleged vulnerabilities, analyzes the merits of the lawsuit, and discusses what it means for other law firms, their clients, and service providers.”
