Evans, Jr. looks at the implications of the Uber drivers class action litigation for a wide range of companies that used independent contractors, and it offers some suggestions for making sure their classification of workers will withstand scrutiny. Among them: Avoid retaining the right to discipline workers, make sure the independent contractor is free to decide the manner and method by which the contracted goods or services will delivered, and make make sure written materials include no “indicia of control.”
