Cosby’s Lawyers File Appeal, Claim Judge Erred

Lawyers for Bill Cosby claim that Judge Steven O’Neill was wrong when he said that Cosby is a violent sexual predator who must be behind bars because he would be a danger to the community. They are asking a Pennsylvania court to overturn his conviction on the basis of errors in his case. The attorneys argued that Cosby’s three to ten year sentence was too harsh. He was convicted in April on three counts of aggravated indecent assault for drugging and sexually assaulting Andrea Constand at his home 14 years ago. The motion argues that a recording of a conversation between Cosby and Constand’s mother, was “not authentic.” The recording was played during the trial. They also said the trial evidence never proved the encounter with Constand took place in 2004, and not 2003, or that Cosby was arrested within the 12-year time limit. Cosby has been in a state prison since the September 25 sentencing, when the judge refused to let him stay out on $1 million bail pending appeal.
