Connecticut High Court Says Man Wrongly Fired For Smoking Pot

The Supreme Court of Connecticut unanimously ruled that a man who was fired for smoking marijuana at work deserves his job back. The justices voted 7-0 that the employee should be suspended, rather than fired, and subjected to one year of random drug testing. Gregory Linhoff was a state employee for 15 years, but was fired after he was caught smoking pot in a state-owned van in March 2012. The Court did not condone Linhoff’s “completely unacceptable” behavior, but when public safety is not an issue, and when employees take responsibility for their conduct, alternatives other than firing should be considered, said Chief Justice Chase Rogers.
